Which Charge Are You Facing?

The wording on your ticket or summons tells you which one it is. If you’re not sure, send us a photograph and we’ll confirm it at no cost.

Provincial Charge

Traffic Safety Act, sections 69 and 71

Failing to remain at the scene, or failing to report an accident.

  • 7 demerit points for failing to remain
  • 3 demerit points for failing to report
  • A fine and possible insurance consequences
  • No criminal record

Criminal Charge

Criminal Code, section 320.16

Failure to stop at the scene of an accident.

  • Requires proof you knew about the collision and intended to leave
  • Mandatory minimum $1,000 fine on a first offence
  • Mandatory minimum 30 days imprisonment on a second
  • Mandatory minimum 120 days on a third
  • A criminal record on conviction

Both can arise from the same incident, and the difference is not about how serious the damage was. The Criminal Code offence turns on knowledge and intent — whether you knew a collision had occurred and chose to leave. The provincial offence turns on the duties the Traffic Safety Act places on any driver involved in an accident. Learn more about the consequences of a hit and run ticket in Alberta.

Frequently Asked Questions about Hit & Run Tickets

What Qualifies As a Hit & Run in Alberta?

Leaving the scene of an accident without meeting the duties the Traffic Safety Act places on a driver — remaining at the scene, identifying yourself on request, and reporting where required. It applies to unattended vehicles and property as well as to collisions involving other people.

Is a Hit and Run a Criminal Offence?

It can be. Alberta has a provincial offence under the Traffic Safety Act and Canada has a separate Criminal Code offence under section 320.16. The criminal offence requires proof that you knew a collision had occurred and chose to leave, and it carries mandatory minimum penalties and a criminal record. Check the section number on your document, or send it to us and we’ll confirm which one it is.

How Many Demerit Points for a Hit and Run in Alberta?

Failing to remain at the scene carries 7 demerit points — the highest single penalty on Alberta’s demerit schedule. Failing to report an accident carries 3.

Will 7 Points Suspend My Licence?

Not on its own if you hold a full licence — suspension follows 15 points accumulated within two years. On a Graduated Driver’s Licence, the threshold is 8, so 7 points would put you close to it. What matters is how many points are already on your record.

I Hit a Parked Car and Left a Note, Is That Still a Hit and Run?

Leaving your details is part of meeting the duty, but the reporting obligation can still apply depending on the damage. The circumstances matter. Send us the details and we’ll tell you where you stand.

How Are the Penalties for Hit & Runs Determined?

Hit and run penalties depend on the extent of the damage caused to other persons or property, and whether or not you are a repeat offender. If this is your first time being charged with a hit and run, and no one has been badly injured as the result of your actions, you will likely face much more lenient fines and other penalties.

However, every hit and run has the power to affect your insurance premiums by a significant amount—so even if this is your first offense, fighting your hit and run charge with help from our experienced team is highly recommended.

What If I Didn't Know I'd Hit Anything?

Whether you knew is a live issue, particularly on the Criminal Code charge where knowledge and intent must be proven. On the provincial charge, the duties are framed around a driver involved in an accident. What you knew, and when, is something the evidence has to address — it is one of the first things we look at.

How Much Is the Fine for a Hit and Run Ticket in Alberta?

It depends on the specific charge. The Traffic Safety Act does not set a fine for failing to remain or failing to report — section 158 provides that offences without a stated penalty are dealt with under the Provincial Offences Procedure Act, so the amount comes from the regulations rather than the Act itself. Send us the ticket and we will tell you what you are facing.

Testimonials

I had a great experience with Stewart and Will, thank you so much! Stewart was very knowledgeable and made me feel very comfortable in my first phone call, while other companies brushed me aside and charged twice the price. I am very grateful that everything was explained to me, and I was treated with respect no matter how many questions I had. In the end, my ticket was withdrawn, and I'm so incredibly grateful that using Wedefendtickets helped me navigate through this stressful situation with ease. 100% would use them again and recommend to anyone! - Robyn

Stewart, Melissa and Derek are a great team of ticket defenders. In my initial conversation with Stewart he set my mind at ease by letting me know what the plan would be in defending my ticket. However, when it seemed like the crown prosecutor might want the charges kept even without a offer to reduce it, Derek stepped in and saved the day for me. THANK YOU all! I will definitely highly recommend your team to anyone who needs help with defending their ticket. - Fredrick

Great service and communication throughout the whole process. I felt at ease, and I had full trust in Stewart. He brought back amazing results, and I had 2 tickets withdrawn for good! Can't recommend him enough! - Melinda

If 6 STARS were an option, We Defend Tickets would easily be in that category. I was facing 3 tickets with 9 points associated with these charges. We Defend Tickets took the time to understand my situation and provided clear details regarding my options; best and worst-case scenarios. I left the decision in Stewart's hands to move forward based on his expertise/ thoughts, and so happy I did... Big thanks for all your work in having the fines reduced and more so, not having any points deducted.

Money well spent and I would recommend your services to all my family, friends and colleagues.

Thank you again and until my next ticket... wishing you well. - Brenda

Stewart is amazing, I would use a better word, if there were.

I remember being scared after the whole incident with the Police and I can't be more grateful he was the one I contacted.

He was very calm, didn't judge me or pass any blame. He was quite affordable. Reassured me He was going to do his best.....went ahead and cleared me, even when some of the tickets were postponed another year due to covid. He waited the whole year and still got me cleared of everything.

No demerits, no records, Nothing. I most especially loved when he said "You're good to go, MY FRIEND" - Omolabake
